Last updated: 27 September 2026
1. Acceptance of these terms
These Terms of Service ("Terms") form a binding agreement between Aravir Technologies Private Limited ("Aravir", "we", "us" or "our") and the campaign organization that subscribes to the Vijetha platform (the "Customer"), together with each individual who accesses or uses the Platform ("you", "User"). By subscribing to, accessing or using the Platform, you agree to these Terms and to our Privacy Policy and Refund & Cancellation Policy, which are incorporated by reference. If you are accepting these Terms on behalf of a Customer, you represent that you are authorized to bind that Customer. If you do not agree, do not use the Service.
2. Definitions
- "Platform" / "Service" / "Vijetha" means the Vijetha voter-management software, comprising the web administration console and the Android and iOS field applications, and related services provided by Aravir.
- "Customer" means the constituency election campaign organization that subscribes to the Service and operates a tenant.
- "Tenant" means the isolated workspace provisioned for a Customer within the multi-tenant Platform.
- "User" means an individual authorized by a Customer to access the Service, such as an administrator, coordinator or field worker.
- "Customer Data" means the electoral and voter data and other content that a Customer or its Users upload to or generate within the Tenant.
3. Eligibility
The Platform is a professional B2B tool made available only for authorized campaign use. To use the Service you must be at least 18 years old, be an authorized representative or staff member of a Customer campaign, and be legally entitled to access and process the voter data you upload or handle. You must not use the Service for any purpose other than the legitimate campaign purposes for which the Customer has subscribed. The Service is not intended for, or offered to, the general public.
4. Account registration & security
Accounts are provisioned for authorized Users. Authentication is performed using a one-time password (OTP) sent to the User's registered mobile number, and access is restricted to authorized devices through device binding. You are responsible for maintaining the security of your account, your device and your access, and for all activity that occurs under your account. You must not share your account, transfer your access to another person, or attempt to circumvent authentication or device-binding controls. You must promptly notify us at hello@vijetha.org of any unauthorized use or suspected compromise.
5. Acceptable use & prohibited conduct
You agree to use the Service lawfully and responsibly. In particular, you must comply with the rules and directions of the Election Commission of India and with all applicable election laws, data-protection laws and other laws that apply to your activities and to the voter data you handle. You must not:
- Use voter or electoral data for any unlawful purpose, or for any purpose other than legitimate campaign activity for which you are authorized;
- Use the Service to harass, intimidate, defraud or unlawfully profile any person;
- Scrape, harvest, bulk-export or extract data from the Platform other than through features provided for that purpose, or attempt to access another Tenant's data;
- Resell, sublicense, rent or otherwise commercially exploit the Service or Customer Data outside the permitted campaign use, or transfer voter data to unauthorized third parties;
- Reverse engineer, decompile, probe, or attempt to gain unauthorized access to the Platform, or interfere with or disrupt its integrity, security or performance;
- Upload malware, or any content that is unlawful, infringing or that you are not entitled to upload;
- Use the Service in any way that violates the rights of others or applicable law.
6. Customer responsibilities for uploaded data
As explained in our Privacy Policy, the Customer is the data controller of the voter data in its Tenant and Aravir acts as a data processor on the Customer's instructions. The Customer and its Users are solely responsible for the lawfulness of the Customer Data they upload and process, including for holding any electoral roll or voter data lawfully, for obtaining any permissions, consents or authorizations required for its collection and intended use, and for ensuring the data is accurate and handled in compliance with applicable law. Aravir does not review Customer Data for legality and is not responsible for the Customer's decisions about what to upload or how to use it. You grant Aravir the limited rights necessary to host, process and display the Customer Data for the purpose of providing the Service.
7. Subscription plans, trials, billing & payments
The Service is offered on a subscription basis, priced per constituency and quoted for the applicable campaign period. We may offer a free trial from time to time; unless stated otherwise, no charge applies during a free trial and the trial may be limited in scope or duration. Paid subscriptions are billed in advance for the applicable term. Fees are payable through our payment gateway, Razorpay, using the payment methods it supports (card, UPI and netbanking). All fees are exclusive of taxes; applicable taxes and statutory levies are additional and are the Customer's responsibility. Fees are quoted per constituency and specific pricing is provided in the applicable quote or order; we do not publish fixed prices in these Terms.
8. Cancellation & refunds
Cancellations and refunds are governed by our Refund & Cancellation Policy, which forms part of these Terms. To cancel, or to raise a refund or billing matter, contact hello@vijetha.org. Except as set out in that policy, fees paid are non-refundable to the extent the Service has been provisioned and made available.
9. Intellectual property
Aravir and its licensors own all rights, title and interest in and to the Platform, including its software, design, trademarks (including the Vijetha name and brand) and all related intellectual property. These Terms grant the Customer a limited, non-exclusive, non-transferable, revocable right to access and use the Service during the subscription term for its authorized campaign purposes, and grant no other rights. The Customer retains all rights in and to its Customer Data; nothing in these Terms transfers ownership of Customer Data to Aravir.
10. Confidentiality
Each party may receive information of the other that is confidential. Each party agrees to protect the other's confidential information with reasonable care, to use it only as needed to perform under these Terms, and not to disclose it except to those who need to know it and are bound by comparable obligations, or as required by law. Customer Data is treated as the Customer's confidential information. These obligations do not apply to information that is or becomes public through no breach, that a party already lawfully held, or that is independently developed.
11. Service availability & warranties
We work to keep the Service available and reliable, but we do not warrant that it will be uninterrupted, error-free or completely secure. The Service may be temporarily unavailable due to maintenance, updates, or factors beyond our reasonable control. To the maximum extent permitted by law, the Service is provided "as is" and "as available", and we disclaim all warranties not expressly stated in these Terms, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.
12. Suspension & termination
The Customer may terminate by cancelling its subscription in accordance with the Refund & Cancellation Policy. We may suspend or terminate access, in whole or in part, if the Customer or a User breaches these Terms (including the acceptable-use provisions), fails to pay fees when due, misuses the Service, or where we are required to do so by law or to protect the security or integrity of the Platform or others. Where practicable and lawful, we will give notice before suspension. On termination, the Customer's right to use the Service ends; Customer Data is handled as described in our Privacy Policy, including deletion on request following termination. Provisions that by their nature should survive termination (including intellectual property, confidentiality, limitation of liability and indemnity) will survive.
13. Limitation of liability
To the maximum extent permitted by law, neither party will be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, revenue, data, goodwill or business, arising out of or relating to the Service or these Terms, even if advised of the possibility of such damages. To the maximum extent permitted by law, Aravir's total aggregate liability arising out of or relating to the Service or these Terms will not exceed the amount of fees paid by the Customer to Aravir for the Service in the three (3) months immediately preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
14. Indemnity
The Customer agrees to indemnify, defend and hold harmless Aravir and its officers, directors, employees and agents from and against any claims, damages, liabilities, losses, costs and expenses (including reasonable legal fees) arising out of or relating to: the Customer Data and the Customer's collection, upload, use or handling of voter data; the Customer's or its Users' breach of these Terms or of applicable law (including election and data-protection laws); or misuse of the Service by the Customer or its Users.
15. Governing law & jurisdiction
These Terms are governed by and construed in accordance with the laws of India. Subject to any applicable law, the competent courts at Nellore, Andhra Pradesh, India will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service.
16. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you should stop using the Service.
